General instruction by USCIS

First, the U.S. relative files a petition with the USCIS, proving their U.S. citizenship and relationship to you. Once the petition is approved, the National Visa Center takes over the case. When their turn comes, the non-U.S. relative has to submit Form DS-261 containing current personal information, as well as pay necessary fees and attach forms and documents, including the Affidavit of Support. Only then can an interview be scheduled for those who pass required medical evaluation.

Affidavit of Support

Form I-864, or Affidavit of Support, has to be filed by a U.S. citizen as a promise to support their foreign relative financially during the first 10 years as a Green Card holder. To be able to qualify as a sponsor, the U.S. relative has to have enough personal income and property themselves, or add additional sponsors to the petition.

What is the difference between a Green Card and Immigrant Visa?

In order for a non-U.S. relative to be able to enter the United States of America and to seek permanent residence here, he or she has to receive an immigrant visa from their local U.S. consulate. A Green Card is granted to those who entered into the U.S. on an immigrant visa. Once on the U.S. soil, the foreign relative can expect to receive their Green Card by mail.

What will happen during the interview at the U.S. embassy?

During the interview a U.S. consular officer will go over your application and ask you different questions about the information you provided in it. If the officer feels that your answers are truthful, your passport will be stamped with an immigrant visa and you will receive a sealed envelope with important documents in it. This packet of documents may only be opened by a U.S. immigration officer at the time of your entrance into the Unites States. It is important to note that you must travel to the U.S. before the immigrant visa expires (expiration date can be found on the visa itself).

What crimes will prevent my relative from receiving a Green Card after the initial interview?

The U.S. immigration services may choose not to grant lawful permanent status to foreign relatives who have a history of violent crimes, involvement in terrorist groups or illegal drug activities. Also, staying in the U.S. on an expired visa or submitting false documentation may cause the USCIS to reject the application for a Green Card. If this happens, a Waiver of Ineligibility may be filed by the foreign relative in some cases.

How long does it take to receive a Green Card for a U.S. family member?

It is very difficult to tell how long it would take to receive a Green Card for a relative of a U.S. citizen since each case is different. There are a large number of petitions filed every year, but the number of visas that can be granted is limited.

My husband was a Green Card holder when he filed I-130 on my behalf. He has his citizenship interview next week. How can we expedite the review of the petition he filed on my behalf once he becomes a U.S. citizen?

Since your spouse was a lawful permanent resident at the time of filing a petition for you, it is possible to change the petition to that of an immediate relative. All he has to do is to send proof of his U.S. citizenship to the National Visa Center. The same can be done for your minor children who are immigrating to the U.S. with you.

Does my U.S. family member have to reside in the U.S. before filing a family member petition?

For the most part, the U.S. citizen has to have their main place of residence on the territory of the United States to be able to file a petition on behalf of a foreign relative. In rare cases, the U.S. petitioner’s short-term living outside the U.S is allowed.
