Are you permanently ineligible for US citizenship?

When you apply for naturalization, the officials will ask if you are permanently ineligible for US citizenship. The short answer is certainly no. Buy the long answer is it depends on various circumstances. The long answer is it depends on various circumstances.

The United States government specifies a relatively long list of requirements to a person to be eligible for naturalization. All the eligibility requirements for US citizenship can be reduced to the following:

  • You must be older than 18, otherwise you are not eligible for naturalization and US citizenship unless your parents or grandparents are permanent US citizens. You should investigate these latter facts.
  • You must be a lawful permanent resident. Put simply, you must be a green card holder of at least 3 years or 5 years in most cases. If you did not acquire a green card, you will not be able to become a US citizen regardless of your marriage with an American or your millions of dollars investment in the country’s economy.

As we can see, if you do not satisfy the minimal eligibility requirements in the list, it does not mean you are permanently ineligible for US citizenship. Which is why we have to mention the reasons how someone can become forever ineligible for citizenship. So here are other most common deeds that lead to ineligibility for US citizenship:

  • The US government will claim you permanently ineligible for US citizenship if you escaped from the US military during a war, avoided the draft, or asked to be freed from responsibility as being a noncitizen.
  • You took part in any actions to overthrow the US government, or supported any banned political force or political trends such as communism and totalitarianism. Any other serious crimes such as murder can bar you from becoming a US citizen as well. But there are several limitations to this requirement. First, you must be an adult when performing such actions. Second, you must exhibit explicit will to perform a crime based on your convictions. Lastly, if any such actions happened 10 years ago or more, then you can become a US citizen.

Getting a permanent ban from becoming a US citizen is possible only if you committed serious crimes. But there are legal ways to avoid this ban.

If you think that some of the above rules may apply to you, you should consult with your immigration lawyer, as there are many stipulations that will let you become a US citizen.

And if you are only planning to become a US citizen, consider getting a Green Card.
