You can file Form I-751, Petition to Remove Conditions on Residence with United States Citizenship and Immigration Services (USCIS), if you received conditional resident status (a conditional Green Card) through marriage to a U.S. citizen or lawful permanent resident and you are seeking the removal of those conditions.
You can also use this form to apply for removal of conditions for your dependent children who acquired conditional resident status on the same day as you or within 90 days thereafter. To do so, include their names and Alien Registration Numbers (A-Numbers) in Part 5 of Form I-751. However, if your dependent children did not acquire conditional resident status on the same day as you or within 90 days thereafter, or if the conditional resident parent is deceased, then those dependent children must each file Form I-751to request removal of the conditions themselves.
You must file Form I-751 jointly with the spouse through whom you obtained conditional status if you are still married. However, there are some circumstances in which you may file Form I-751 without your spouse. You may do so if:
You got married in good faith, but your spouse subsequently died;
You got married in good faith, but the marriage later ended in divorce or by annulment;
You got married in good faith, but you were later battered or subjected to extreme cruelty by your petitioning spouse; or
Your conditional resident parent got married in good faith, but you were later battered or subjected to extreme cruelty by the parent who is a conditional permanent resident of the United States and/or the parent who is already a U.S. citizen or lawful permanent; or
You would be forced to endure extreme hardship as the result of the termination of your status and removal from the United States.
