To qualify for TPS, you must be legally admissible to the United States. However, USCIS is authorized to grant waivers in certain cases. You can find more information and learn whether you are eligible for a waiver by reviewing the “What Waivers are Available for TPS portion of the Instructions for Form I-821.
If you are re-registering for TPS and you previously received a waiver in connection with a TPS application, there is no need to seek another waiver for the same action, incident, or circumstance. For example, if on a prior TPS application, you received a waiver of the health ground of inadmissibility because you had a contagious illness or condition that was treated, you do not need to apply for another waiver for that same illness or condition. However, you must file for a new waiver if you have contracted another contagious illness for which one is required.
Finally, you cannot file Form I-821, Application for Temporary Protected Status for your family members. Instead, each person seeking TPS must qualify and apply for him or herself on a separate Form I-821.
Fill the Form I-821
Complete this form by answering all questions fully and honestly, and signing it. Do so by typing or writing neatly in black ink. If you need extra room to answer any questions, use the space provided in Part 11, Additional Information. You may also use separate sheets of paper as long as you type or print your name and Alien Registration Number (A-Number) (if any) at the top of each sheet. You must also indicate the page number, part number, and item number to which your answer refers; and sign and date each sheet.
If a question does not apply to you put “N/A,” in the space provided unless the instructions specify differently. If your answer to a question which requires a numeric response is zero or none, put “None” in the space provided unless the instructions specify differently.
Finally, you must provide answers for the following parts and item numbers. Failure to answer these questions may result in unnecessary delays or the denial of your application.

- Part 7. Eligibility Standards – All questions must be answered;
- Part 8. Applicant’s Statement, Contact Information, Certification, and Signature;
- Part 9. Interpreter’s Contact Information, Certification, and Signature (if you used an interpreter); and
- Part 10. Contact Information, Declaration, and Signature of the Person Preparing this Application, if Other than the Applicant (if you used a preparer and/or have a legal representative).

There is no need to provide original documents with this application unless USCIS asks you to provide them along with the copies you provide.
If you are making an initial request for TPS (if you have not applied before), you must submit copes of certain documents proving: that you are from a country designated for TPS (or that you have no national identity but that you lived a country designated for TPS immediately prior to coming to the United States); the date you entered the United States; and your U.S. residence.
If you are filing this application for re-registration (as specified in Part 1., Item Number 1.b., of Form I-821), there is no need to submit copies of any documents. However, USCIS may request additional information and/or documentation depending on the circumstances of your case.
If you are submitting a first-time re-registration with USCIS following an Immigration Judge or Board of Immigration Appeals decision granting your request for TPS you should include a copy of that decision order with your Form I-821. This helps USCIS in confirm your official request has been granted and facilitates the processing of your application.

First-time TPS applicants must submit a $50 fee for Form I-821. However, there is no Form I-821 fee for re-registration. If you are 14 or older, you must also pay the $85 fee for biometric services.
You may have to pay different fees depending on the specific circumstances of your case. To learn more, visit the Form I-821 page on the USCIS website.
Acceptable forms of payment are money orders, personal checks, or cashier’s checks. If you pay by check, you must make your check payable to the U.S. Department of Homeland Security.
Service centers cannot process credit card payments. However, if you are filing at a USCIS Lockbox facility, you may also pay by credit card using Form G-1450, Authorization for Credit Card Transactions.
Do not forget to sign your form; USCIS automatically rejects unsigned forms. Once you have completed the form and gathered all of the supporting documents send everything (including payment for fees) to the address listed in the Federal Register notice or Temporary Protected Status (TPS) webpage.
