Before submitting the renewal application for DACA you must first satisfy ALL of the following requirements:
- No trips outside the US on or after August 15, 2012, without advance parole;
- Continuous presence in the US since your last DACA request was approved;
- No felony or significant misdemeanor convictions, or three or more misdemeanors; and
- Do not pose a threat to public safety or US national security.
Your request to renew DACA must be submitted within the timeframe dictated by USCIS or you may lose your DACA. It is strongly recommended that you submit your renewal request between 150 days and 120 days before the expiration date on your employment authorization card and DACA approval notice. To minimize the possibility that your DACA will expire before your renewal quest is approved, you should file within the given time frame.
When requesting DACA you must file a Form I-821D, Consideration of Deferred Action for Childhood Arrivals; Form I-765, Application for Employment Authorization; and I-765WS, Worksheet. In addition to the forms, you must also include the following documents:
- Filing fee of $465; and
- Documentation of criminal convictions, if applicable.
Upon receipt of the application, USCIS will review the information submitted. You will receive a notice for a biometrics appointment, which you must attend. Following your appointment USCIS may request additional information if you have failed to establish your eligibility. USCIS will then either deny or grant your application. You will receive the approval notice and your employment authorization card shortly thereafter. If your request has been pending longer than 105 days you may submit a request to USCIS for action on your request.
What happens if I don’t renew my DACA?
You will lose your deferred status in the US, as well as any DACA benefits including your Social Security number, work permit and deferred deportation period. Without these benefits you may not be able to renew your driver’s license or work.
I was stopped by the police after I got DACA. Can I still renew my DACA?
Depending on what happened, you may be able to renew your DACA. If you have any criminal charges or convictions you should speak to an attorney. When you apply you will have your fingerprints done again and your fingerprints will be used to check your criminal record. If you have been convicted of certain crimes your application could be denied and you could be deported.
Following the initial interview, USCIS has 120 days to either grant or deny a naturalization application. If a decision is not made within 120 days then the applicant may petition to have either the court or USCIS make a decisionI recently received my DACA and EAD renewal for a period of two years, but President Obama announced that DACA will now be granted for three year periods. Will my DACA now be extended for an additional year?
No. The three year grants of DACA have not been implemented due to a court order and USCIS is only able to issue DACA and EADs for two year periods.
Will I be placed in deportation proceedings if my DACA renewal request is denied?
Unless your case involves a criminal offense, fraud, or a threat to national security or public safety, USCIS states that if your DACA renewal request is denied your case generally will not be referred to ICE.
I am no longer in school, am I able to renew my DACA?
Yes. The application to renew does not request information regarding your current school enrollment or graduation. You must only meet this requirement for your initial application, not to renew.
When I initially applied for DACA, I was under 31 years old but now I am over 31 years old. Can I still apply to renew my DACA?
Yes, you do not need to be under 31 to apply for a renewal.
