Nonimmigrants that will be coming to the U.S. To perform in athletics or entertainment may be eligible for a P visa. Since people seeking a P visa often need the visa quickly to make it to an event or competition, premium processing is available. Admission under a P visa is generally for the duration of a specific competition, performance, or event. If an employer and/or agent in the United States terminates the P visa holder, the employer and/or agent must pay costs of transportation back to the home country of the P visa holder.

There are three different categories of P Visas, which are as follows:

  • P-1: Athlete or member of an athletic team; Member of an entertainment. To be eligible for a P-1, you must be an internationally recognized athlete, individually or as part of a group, or a member of internationally recognized entertainment group.
  • P-2: Artists and entertainers in exchange programs. To be eligible for a P-2 you must be an artist or entertainer coming to the US under a reciprocal exchange program.
  • P-3: Culturally unique artists and entertainers. To be eligible for a P-3 you must be an artist or entertainer coming to the US under a culturally unique program to perform, teach, or coach.
  • P-4: This visa is available for dependents of P1, P2, or P3 holder. Eligible dependents are spouses and/or unmarried children under the age of 21.
  • Essential Support Personnel – P visas are also available for support personnel who perform support services that can not be readily performed by a U.S. Worker. Includes: coaches, scouts, trainers, and team officials.

General instruction by USCIS

To apply for a P visa you will first need to submit the following documents:

  1. Form I-129, Petition for a Nonimmigrant Worker;
  2. Copy of contract, description of oral agreement, or summary of terms of employment between petitioner and alien;
  3. Advisory opinion written by an appropriate labor organization;
  4. Description of the events in which the P visa holder will participate or perform; and
  5. Start and end dates of the event or activity.
The petition and supporting documents must be sent to USCIS along with the appropriate filing fees. If you choose to use premium processing, you must also include a Form I-907, as well as an additional filing fee of $1,225.

Frequently Asked Questions

Our team is acquiring a new player who is in the US on a P1 visa from a different team. Do we need to file a new petition?

Yes. Employment authorization for a P1 athlete will automatically continue for 30 days after transfer to the new team, however, the new team is expected to file a new petition during that time.

A petition has been filed and approved for a member of our performance group, but we would like to bring a different performer to the US. Do we need to file a new petition?

No. You may substitute beneficiaries in approved P1, P2, and P3 petitions for group. Also, you may include more than one beneficiary in the petition. These beneficiaries can include essential support staff.

I will be coming to the US to tour with my band. We will be performing at several different locations for a year. Do I need separate petitions for each performance?

No. Your petition should include an itinerary which lists the dates and locations of all your performances. You will need a separate petition if you will be performing for different employers, unless your agent files the petition for you rather than the employer.
