Green Card through a refugee/asylee status
Once an asylee has had asylee status for a year, he/she may apply for a green card by filing a Form I-485 (Application to Register Permanent Residence Status or Adjust Status). After the application has been submitted, USCIS will send a notice to applicants over 14 years old of an appointment to have his/her fingerprints taken after which it should mail the green card to the applicant’s home address.

Refugees must apply for permanent resident status one year after being admitted to the United States. While asylees are not required to apply for this status, they may do so after being granted asylum for one year. Permanent resident status allows asylees to become U.S. citizens in the future. It also makes their spouse and children eligible for a green card if they were (1) admitted to the U.S. as asylees or (2) included in the permanent resident’s grant of asylum.

When can you apply for a green card?
If you were granted asylum while present in the US, you may apply one year after your application has been approved. Asylees are not required to apply for a green card after 1 year, however, it is likely in your best interest to do so. The law requires you to apply for a green card 1 year after being admitted in the U.S. as a refugee. If you entered the U.S. as a refugee or as a qualifying family member of an asylee, you may apply for your green card 1 year after entering the U.S.
Spouse and children who were admitted to the U.S. as asylees or if they were included in your grant of asylum, may also apply for a green card.
What is a refugee?
A refugee is a person who has had to flee his/her home country for fear of persecution, war, or violence. These people are typically victims of mistreatment in their home country because of their religion, political views, or race. They also may be fleeing war or violence. Applicants for refugee status are typically outside of the U.S.
What is an asylee?
An asylee is a person who is seeking protection as a refugee and has applied for asylum or has received asylum. Asylum is given by the United States government to people who cannot return to his/her home country for fear of persecution. People who are granted asylum are typically victims of mistreatment in his/her home country because of his/her religion, political views, or race. Once a person is granted asylum he/she is protected from deportation and may remain in the United States.
