DACA allows immigrants who came to the United States as youths and who satisfy other special requirements to apply for a work permit and 2-years’ immunity from deportation. However, DACA will not remedy everything for these young immigrants. It will not grant amnesty, a green card, or United States citizenship. General instruction by USCIS
Before submitting the application for DACA you must first satisfy ALL of the following requirements:
- You were under the age of 31 as of June 15, 2012;
- You arrived in the United States before your 16th birthday;
- You have continuously resided in the United States since June 15, 2007 up to the present;
- You were physically present in the United States on June 15, 2012 and when you submit your application for DACA;
- You are currently in school, have graduated, obtained your GED, or have been honorably discharged from the Coast Guard or Armed Forces of the United States; and
- You have not been convicted of a felony, significant misdemeanor, or three or more misdemeanors, and do not pose a threat to national security or safety. -821D, Consideration of Deferred Action for Childhood Arrivals
When requesting DACA you must file a Form I-821D, Consideration of Deferred Action for Childhood Arrivals; Form I-765, Application for Employment Authorization; and I-765WS, Worksheet. In addition to the forms, you must also include the following documents:
- Filing fee of $465;
- Copy of your birth certificate and translation (if necessary);
- Copy of photo ID;
- Proof of continuous presence;
- Proof of graduation or enrollment in GED programs; and
- Any additional documentation establishing your eligibility for DACA.
Upon receipt of the application, USCIS will review the information submitted. You will receive a notice for a biometrics appointment, which you must attend. Following your appointment USCIS may request additional information if you have failed to establish your eligibility. USCIS will then either deny or grant your application. You will receive the approval notice and your employment authorization card shortly thereafter.
Can I appeal if my application is denied?
No. There is no option for an appeal but you may submit the application again.
Will I be placed in removal proceedings if my DACA application is denied?
Your case will only be referred to ICE if your case involves a criminal offense, fraud, or a threat to national security. USCIS does not refer cases to ICE for any other reason unless there are exceptional circumstances.
Can I travel outside the United States with DACA?
Yes, for humanitarian, employment, or educational reasons only. Once your application is approved you can file a Form I-131 requesting advance parole from USCIS. Advance parole does not guarantee re-entry to the United States and you should consult an attorney before traveling abroad. Many DACA recipients have been able to travel abroad and allowed to re-enter the United States with advance parole, but each case is different.
I left the United States after June 15, 2007 but before August 15, 2012 and then returned. Can I still apply for DACA?
Maybe. Continuous presence is not broken for trips abroad that are brief, casual, and innocent. Trips are considered brief, casual, and innocent if:
- The trip was before August 15, 2012;
- The trip was short and reasonable to accomplish purpose of trip;
- The trip was not because of a deportation order; and
- The trip was not for the purpose of criminal activity.
