Advance Parole for Asylees

An asylum applicant who has a pending Form I-589, Application for Asylum and for Withholding of Removal, and has not received a final decision may be allowed to travel outside the United States.

If you are an asylum applicant and you intend to travel outside the United States and return you must apply for and receive advance parole. If you leave the United States without first obtaining advance parole, we will presume you abandoned your asylum application.

Advance parole does not guarantee that you will be allowed to reenter the United States, rather, an immigration inspector from U.S. Customs and Border Protection (CBP) must inspect you and determine whether you will be allowed to reenter the United States.

Refugee Travel Document

A refugee travel document is issued to a person who has been granted refugee or asylum status, or to a permanent resident who obtained a green card because they were a refugee or asylee.

General instruction by USCIS

Form I-131, Application for Travel Document, must be completed to obtain a refugee travel document. When filing the application you also must include a copy of the document issued to you by USCIS which shows your refugee or asylee status, as well as the expiration date of this status. If you are applyling from outside the United States you must also include two passport size pictures of yourself.

Frequently Asked Questions

Can anyone with a grant of asylum travel abroad with a Refugee Travel Document?
No. If you have received asylum or witholding of removal under the Convention Against Torture, you can never travel abroad. If you leave the U.S. you would not be permitted to re-enter since you would be enforcing your own removal order and deporting yourself.
Are there any risks when traveling with a Refugee Travel Document?
Yes, when returning to the U.S. you are not guaranteed entry. A border control official will have to grant you entry, even with an approved Travel Document. If you first entered the country illegally or with a fake passport, usually you are not allowed to return to the U.S. after leaving. Those who are granted asylum, however, are generally not kept from returning for this reason. Criminal convictions, however, can be an issue. If you have any criminal convictions you should consult with an immigration attorney or you should not travel. Refugee Travel Documents may be given to people who have criminal convictions even though they will not be allowed to return to the U.S.
Can an asylee travel back to his/her home country?
Yes, but your asylum can be terminated if you are no longer a citizen of that country, you are no longer eligible for asylum due to a fundamental change in circumstances, or if it is determined that you received asylum by committing fraud in your application. When traveling to your home county you will have to be prepared to explain how you were able to return there. If the government determines that you no longer fear your home country your asylum may be terminated. It is usually recommended that you do not travel to your home country to avoid losing your asylee status.
Do I need to use my passport when I travel with my Refugee Travel Document?
No, when traveling an asylee must only travel with the Refugee Travel Document issued by the U.S. government. Traveling with a passport issued by the country from which you were granted asylum could cause you to lose your asylum.
What is the filing fee for an asylee travel document?
If you are 16 years or older, the filing fee is $135. If you are filing for a child younger than 16, the filing fee is $105. There is an additional fee of $85 if you between the ages of 14 through 79 for biometrics services. If you filed a Form I-485 (Application for Permanent Residence) after July 30, 2007 and your application is still pending, you do not have to pay a fee, as long as you already have U.S. refugee or asylee status.
What is the current processing time for an asylee travel document?
Applications for asylee travel documents are sent to the Vermont Processing Center for USCIS. The processing time is typically 3 months, but this can be longer depending on how many applications the center has to process.
How long is a Refugee Travel Document Valid?
A Refugee Travel Documen tis valid for up to a year and cannot be extended.
If you have permanent residency do you still need to obtain a Refugee Travel Document?
Yes. For travel abroad, you will still need to obtain a Refugee Travel Document first. Once an asylee becomes a U.S. citizen, he/she no longer needs a Refugee Travel Document to travel to another country. When applying for citizenship, USCIS will review all travel history and if you have traveled to your home country, from which you were claiming asylum, you may have your asylum grant re-opened and it could be revoked.
What is a Refugee Travel Document?
A Refugee Travel Document gives people who have been granted refugee or asylee status to return to the United Staates after traveling abraod. This permission may also be granted to permanent residents who are also refugees or asylee. Without this document or an Advance Parole Document a refugee or asylee may not be able to return to the United States. The document does not guarantee that the person will be allowed to enter the United States since a Department of Homeland Security officer will determine your admissibility at the port of entry when you return and provide him/her with your travel document.
