Typically, lawful permanent residents are allowed to leave the United States and return freely. However, limitations may sometimes apply and a re-entry permit can help you avoid two situations that might occur:
- Your Permanent Resident Card becomes technically invalid for re-entry to the U.S. if you stay abroad for longer than 1 year.
- Your permanent residence in the U.S. may be considered surrendered if you are gone for less than 1 year but take up residence abroad.
A re-entry permit declares that you do not intend to surrender your status, and lets you apply for admission to the United States after traveling abroad for up to two years without having to obtain a returning resident visa. Typically, a re-entry permit is valid for 2 years from the date it is issued.
There are several scenarios where a re-entry permit would be useful. Obtaining a re-entry permit prior to leaving the U.S. for more than 1 year, but less than 2 years, protects your permanent residency status while you are abroad. If you travel outside the U.S. frequently for stays of 1 year or less, obtaining a re-entry permit demonstrates your commitment to maintaining your permanent residency status. Also, if you will be traveling abroad and cannot or do not wish to get a passport from your country of origin, you may want to get a re-entry permit.

General instruction by USCIS
For a re-entry permit, you must file Form I-131, Application for Travel Document. Permanent residents and conditional residents must include the following documents with their Form I-131:
- Evidence of permanent residency status, including a photocopy of both sides of your green card, or your passport page displaying your admission as a permanent resident;
- Two passport-style photos of you;
- Application fee and biometrics fee.
How long will it take to obtain a re-entry permit?
Typically, it takes approximately 3 months for USCIS to process a re-entry application.
If I file the Form I-131 to obtain a re-entry permit while I am in the U.S., but leave while it is still pending, will USCIS deny my application?
Although you must be physically present in the United States when you file Form I-131, you do not have to be in the U.S. for USCIS to approve and issue your re-entry permit, provided your photo and fingerprints were submitted before you left the United States.
As a lawful permanent resident I need to travel abroad, can I file my form I-131 to obtain a re-entry permit while I am outside the United States?
No. You must be physically present in the United States when you file the Form I-131 to get a re-entry permit.
Will a re-entry permit guarantee admission to the United States?
No. Similar to a U.S. green card, a re-entry permit does not guarantee your admission to the U.S. Normally, aliens who are permanent residents are allowed to enter the U.S. if their re-entry permits are valid. However, you are still subject to the USCIS inspection protocol at the port of entry.
Who is not eligible for a re-entry permit?
Aliens in the United States are ineligible for a re-entry permit unless they are permanent residents or conditional permanent residents.
