A joint sponsor is a person who has agreed to accept the legal responsibility of financially supporting your family member along with you. He or she must be able to satisfy the same requirements as you, but they do not have to be related to the immigrant. The joint sponsor, along with his or her household needs to meet the 125% income requirement without the help of the petitioning sponsor. Co-sponsors are not permitted to combine their income to satisfy the requirement.
In the event the visa petitioner dies after USCIS has approved the visa petition and the agency allows the petition to proceed, a substitute sponsor will need to file a Form I-864 in the place of the decedent. To be eligible as a substitute sponsor, the intending immigrant must be a family member of yours. Additionally, you must:
- be a U.S. citizen, national or green card holder;
- be 18 years of age or older;
- live in the U.S.;
- fulfill the financial requirements of sponsorship.

General instruction by USCIS
As a sponsor, you should complete Form I-864 once an immigrant visa interview has been set up for your family member living abroad, or when your family member is ready to turn in their application to the USCIS for adjustment of status. Joint sponsor(s) must complete Form I-864, as well. If income from other members of your household is being used for qualification, each person will need to fill out an individual I-864A, Contract Between Sponsor and Household Member.
Proof of your employment and a copy of your most recent U.S. federal tax return must accompany the completed application. If, for any reason, you did not have to file an income tax return, you will need to provide an explanation. Failure to provide any of this information will result in a delay or denial of your family member’s application.
I want to be a sponsor, but I don’t meet the minimum income requirements. Is there anything else I can do?
There are some exceptions, but if your earned income alone does not fulfill the income requirements, you may be able to count your assets, along with the assets of other household members and the family member you are sponsoring.
Which family members can act as a substitute sponsor?
To be an eligible substitute sponsor, you must be a parent, spouse, sibling, child (at least 18 years old), grandparent, grandchild, an in-law, or legal guardian of the intending immigrant.
What are the responsibilities of a joint sponsor?
Just like the petitioning sponsor, a joint sponsor whose income is used to meet the income requirements is financially responsible for supporting the sponsored immigrant.
When should I not submit an affidavit of Support?
There are several reasons you might not need one. Intending immigrants who have earned 40 qualifying credits of work in the U.S., have an approved I-360, and orphans adopted abroad by U.S. citizens who meet all the requirements do not need to file an affidavit of support.
