General instruction by USCIS

To request your information you need to complete the Form G-639 (Freedom of Information Act/Privacy Request) or write a letter containing the following information:

  1. Your full legal name and other names used.
  2. Your mailing address. If your mail is sent to someone else include “In Care Of Name” as part of your mailing address.
  3. Describe records requested. You can state, for example, “My citizenship application and supporting documents” or, if you want all your information, “All records pertaining to myself”.
  4. Your Alien number (also known as A #) if you have one.
  5. Any other identifying information to help the government identify you from others such as your passport number, I-94 (Departure Record) number, visa number, application receipt number and date it was filed and similar information.

Your G-639 or written request must be signed in front of a notary if you are inside the United States. If you are currently outside the country you can declare under penalty of perjury under the laws of the US that the information in the request is complete, true and correct.

Once the request has been submitted you will receive an acknowledgement letter from the government containing a case number that you can use to track the status of your FOIA or PA case.

How to Request Records For Somebody Else

To request information for somebody else you need to complete the Form G-639 (Freedom of Information Act/Privacy Request) or write a letter containing the following information:

  1. Your full legal name and address.
  2. All names used by the person whose information is requested (Subject of Record).
  3. Describe records requested and reason for the request.
  4. Provide the person’s Alien number (also known as A #) or any other identifying information to help the government identify him/her from others such as passport number, I-94 (Departure Record) number, visa number, application receipt number and date it was filed and similar information.
  5. Include Subject of Record’s certification stating that he or she consents to releasing the requested record to you. If the person is deceased you must provide a copy of his/her death certificate or any other documents to prove the fact of death.

Expeditious Processing

If you need your information as soon as possible you should attach a letter describing your circumstances and requesting expeditious processing of your case. Be as specific as possible and include evidence of the circumstances that require urgent release of the requested information.

If I didn’t receive my information from the Government, what can I do?

To check the status of your case you need to have a Case Number (also known as Control Number). When you submitted your FOIA request the government provided you with an acknowledgment letter containing the Control Number. The number usually begins with letters NRC, COW, etc.) If you have the control number you can check the status of your FOIA request here.

How long do I have to wait for copies of my documents from the government?

The amount of time you need to wait depends on complexity of your immigration history and how far back it extends. In addition, your wait time will be longer if haven’t provided or do not haven an Alien Number (A#). Approximate wait time is as follows:

If A# is provided:

  • 30 Days – Simple Requests (usually recent information);
  • 111 Days – Complex Requests (usually if more than one case or people involved);
  • 31 Days – If the information is requested from the Immigration Court or Judge.

If A# not provided or doesn’t exist:

  • 59 Days – Simple Requests (usually recent information);
  • 122 Days – All other request (Complex, old, voluminous).
