Your Form I-485, Application to Register Permanent Residence or Adjust Status, must be accompanied by the corresponding filing fee and biometric services fee (if applicable). Currently, in most cases it will cost you $1,225 to apply for adjustment of status. But the sum depends on many factors that are listed below.
The standard filing fee for Form I-485 is $1,140. However, if an applicant is 13 years old or younger and he/she is filing with a parent’s Form I-485, in that case the filing fee is reduced to $750.
The standard biometric services fee that has to be paid by all applicants between 14 and 79 years old is $85. However, if an applicant is 13 years old or younger OR 79 years old or older, he/she does not need to pay any biometric services fee. And in case when an applicant turns 14 years of age while the application is still pending, he/she will then have to pay an $85 biometric services fee before USCIS will adjudicate the application.
Besides, there is a fee waiver in certain situations. For example, you do not need to pay either filing or biometric services fee if:
– you are a refugee adjusting status under INA section 209(a);
– you are eligible for a fee waiver under 8 CFR 103.7(c) based on your inability to pay;
– you are in deportation, exclusion, or removal proceedings before an Immigration Judge.
Keep in mind that you must submit all fees in the exact amounts. You may pay by check or by money order. Also, note that the filing fee and biometric services fee are not refundable, regardless of any action USCIS takes on your application.
