Generally, you are eligible to file Form I-130, Petition for Alien Relative, if you are a U.S. citizen or lawful permanent resident and you want to help your foreign family members to receive permanent resident status and immigrate to the USA.
If you are a U.S. citizen, you may file Form I-130 for: your spouse; your unmarried children under the age of 21; your unmarried sons and daughters 21 years of age or older; your married sons and daughters of any age; your brothers and sisters (you must be at least 21 years old); your mother and father (you must be at least 21 years old).
If you are a lawful permanent resident of the USA, you may file Form I-130 for: your spouse; your unmarried child under the age of 21; your unmarried son and daughter 21 years of age or older.
Non-citizen U.S. nationals have the same rights as lawful permanent residents to petition for family members.
Please note that you must file a separate Form I-130 for each eligible relative. However, this does not apply to the derivative beneficiaries, they may apply for an immigrant visa along with the beneficiary.
