People in the following categories may use Form I-765, Application For Employment Authorization: asylees/refugees and their spouses and children; foreign students; employment-based non-immigrants; and family-based non-immigrants.

You may also use this form if you have Temporary Protected Status (TPS); if you are an eligible dependent of an employee of a diplomatic mission, international organization or NATO; if you are applying for adjustment of status; if you meet the criteria for certain nationality categories or “other categories.”

Complete your request for an EAD by using a typewriter, computer or writing neatly in black ink and answering all questions fully and truthfully. If a question does not apply to you, put “N/A” in the space provided and if the answer is “none,” write or type that in the space provided.

If you need more room to answer any question, attach an extra sheet of paper with your name and Alien Registration Number (if applicable) at the top and identify the question or part of the question you are answering. Do not forget to sign and date each page.

Be sure to sign the form and send payment for the filing fees and supporting documents along with the application.

All applicants must provide the following along with Form I-765, Application For Employment Authorization and $410 for the associated filing fee: Form I-765WS (to show economic necessity — if applicable); a copy of Form I-94, Arrival-Departure Record (front and back), if available unless you are applying under (c)(9) designation; and a copy of your last EAD (front and back) or a government-issued Photo ID if this is the first time you’re applying for an EAD.

You must also provide two identical color photographs of yourself taken within 30 days of filing your application. The photos must have a white to off-white background, be printed on thin paper with a glossy finish, and be unmounted and unedited.
