How to obtain dual citizenship in the US and Germany?

People from Germany are migrating to the United States with the hope to find new prospects. As reported in 2016, almost 45 millions of Americans are actually Germans which translates into 14.4 percent of the entire US population. If you want to join on the biggest ethnic German population in the United States, there is nothing difficult. You can consult with our specialists and apply for US citizenship providing you are eligible for it.

But the real question is whether you are allowed to be a bipatride with German and US citizenship? The United States have no restrictions or interdiction with regard to acquiring a dual citizen status, but Germany does. You can acquire dual citizenship in Germany only under the following conditions:

  • You are coming from European Union or former Soviet Union countries.
  • Your native country prohibits you to give up your original citizenship.
  • You are an ethnic German.
  • You were born by parents from the United States.
  • You have obtained permission from the German authorities to retain another citizenship.

As you can see, you can acquired US citizenship through parents even if you were born in Germany (Germany recognizes the citizenship by the soil). Otherwise, the only legal way to get US citizenship and keep German citizenship is to apply a special permission to the German government. The permission is called Beibehaltungsgenehmigung, or simply Retention Permission. Should you not file this form to the German government before you acquire US citizenship, your German citizenship will be automatically canceled.

Germany has a special condition that lets you avoid filing this form. If you were born in the United States, but your parents are German nationals, then you acquire Germany nationality and citizenship by parentage. At the same time, any child who was born on the US soil will become an American. The dual citizen status is given to you automatically, and neither the United States nor Germany are able to deny this status for you.

Therefore, you can legally become an American and you may first need to verify if you were born on the American soil. Otherwise, you should get a permission from the German government before applying for US citizenship if none other condition that we listed applies to you.
